Mandatory Binding Arbitration & Class Action Waiver

All disputes, claims, or controversies ("Disputes") related to these Terms shall be resolved exclusively through binding arbitration, not in court.
This applies to all claims, including those based on contract, tort, statute, fraud, or misrepresentation.
Arbitration Procedures
Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
The arbitration will take place in Dallas, Texas, unless both parties agree otherwise.
The arbitrator has exclusive authority to resolve all disputes.
Each party will cover its legal fees, unless the arbitrator awards costs to the prevailing party.
Class Action & Jury Trial Waiver
No Class Actions: Disputes must be brought individually. You waive any right to participate in class actions.
No Jury Trial: You waive your right to a jury trial.
Exceptions to Arbitration
Either party may bring an individual claim in small claims court if eligible.
Claims seeking injunctive or equitable relief related to intellectual property are exempt.
Governing Law for Arbitration
